Is surrogacy legal in Ukraine?

Yes. Ukraine is famous for its positive attitude to surrogacy

Who can participate in surrogacy programs in Ukraine?

Surrogacy in Ukraine is only allowed for married couples. Same-sex couples are not allowed to participate in programs.

Is surrogacy allowed in Ukraine for men or women who do not have partners?

Unfortunately, no. Couples whose marriage is officially registered can use the surrogacy service in Ukraine.

Could the surrogate mother from Ukraine have any rights for the baby?

No, due to the law, the surrogate mother does not have any right as a mother for the child. The fact of surrogacy stays confidential and the names of Intended Parents are specified on the original birth certificate.
It is regulated in accordance with the provisions of article 123, Part 2 of the Family Code of Ukraine, which states: «The parents of the baby born by methods of assisted reproduction will be those who conceived the embryo, even if it was implanted in the womb of another woman (surrogate mother).»

What happens if the surrogate does not want to give my baby?

Before starting the surrogate process, a couple signs the contract with the surrogate. According to the contract, the surrogate mother confirms that she has no rights for the baby.

Can PGD/PGS testing be done?

Yes, PGD/PGS testing is allowed. It is used to screen for specific genetic diseases and also for gender selection.

What is the fee payment structure?

The overall fee is divided into 4 instalments paid upon signing the contract, at week 12 of pregnancy, week 24 of pregnancy and after discharge from the maternity hospital

Are legal fees included in the contract?

Legal fees for the exit process support and coordination are included in the contract. Legal fees associated with the legal procedure in your home country are not included in the package and will need to be organized and paid for separately.

Is there a waiting time for surrogates?

We have surrogates who are willing and available so quite often the matching process will not take long. For Ireland and the UK, the surrogate has to be single or divorced, so in this case, it might take 2-3 months

How do you match surrogates to IP's? Will you give us options?

We usually send a profile of the surrogate which is matched in terms of her marital status (for Ireland, UK) as well as whether the IPs would like to transfer 1 or 2 embryos per transfer. We can take into account the special requests that you might have (ie travelling distance to Kyiv, age of biological children, experienced surrogate) but please note that this might increase the matching time. In case the intended parents like the surrogate profile we can arrange a Skype call to e-meet the surrogate as the next step.

What is the social background of the surrogates – are they married? Do they already have children? Have they been surrogates before? Did they go to university?

It differs. For Ireland and the UK, the surrogates need to be either single or divorced. They must have biological children of their own and pass medical and legal screenings before we will take them on board. Some have been surrogates before they are known as experienced surrogates. For them, financial motivation/compensation is very important. They will buy a car, an apartment or spend the money on education for their kids, but at the same time, they are also eager to help other people who are unable to become parents. How do you ensure the surrogate is alcohol and drug free during her pregnancy?

Every month our pregnant surrogates come to Kyiv for regular check-ups and take compulsory alcohol and drug tests to ensure they are drug/alcohol-free

What medical tests do you provide for the surrogate during the pregnancy?

The surrogate comes to Kyiv for medical checkups and tests regularly every 2 weeks once pregnancy is established and confirmed with a scan. She takes blood tests every month. GTT test is taken at 24 weeks. In the 2nd trimester, she will undergo most of the tests and screenings that she has gone
through before being accepted into the program to include HIV, syphilis, Hep B and C as well as TORCH infections. From week 20 there is also Doppler echocardiography procedure carried out 3 times before delivery and at week 32 there a cardiotocography procedure. In case there are additional recommendations from the doctor all will be carried out in order to support a healthy and progressive pregnancy.

Is it possible to have a known Egg Donor from Ukraine who we may know her identity?

No. Unfortunately egg donation is anonymous in Ukraine.

Who is eligible for surrogacy in Colombia?

The Colombian constitution explicitly disallows discrimination and the courts have recognized all family types since 2015. So therefore surrogacy in Colombia is available to everyone.

Do I have legal representation through the whole process?

Yes, you will have legal representation from the very start of your surrogacy journey, until you receive the birth certificate for your baby, and throughout any court process that may be needed to remove the surrogate mother from the birth certificate. We only work with highly skilled legal professionals to ensure the surrogacy process goes as smoothly as possible.

Do I have to meet any requirements to be accepted to the guarantee program? (for LGBT+ partners)

Yes, you and your partner, if applicable, must provide a recent criminal record check and undertake a psycho-social evaluation (online) to be eligible to participate, the same as we expect from our surrogate. Furthermore, we would require recent (not older than 6 months) medical checkup for infectious diseases (HIV, syphilis, hepatitis b/c) and a semen analysis.

Where should I stay on my first visit to Colombia?

You may choose to stay anywhere, as Bogota offers a wide variety of accommodation options ranging from standard to premium options. But we would recommend a hotel close to the clinic itself to make the process more efficient. Please feel free to ask our intended parent partner for recommendations on where to stay in Bogota.

Am I able to ship sperm or embryos at the beginning of the program and sign my contract remotely?

You may ship biological materials, as long as country boarders are not closed down. You can sign the main contract remotely but a visit to Bogota is required for the signing of other documents (power of attorney, contract with the surrogate mother), but it can be as short as 3-5 working days.

Is Colombia safe?

Although Bogota gets a lot a bad press, Bogotá, Colombia is now one of Latin America’s safest cities and is ranked safer than many U.S. cities in terms of crime. Furthermore, our clinic is located in one of the best areas of the city (CBD) and is considered very safe.

What testing is conducted on egg donors?

Donors undergo psychological screening as well as genetic carrier screening for various inheritable diseases such as cystic fibrosis, fragile x, and spinal muscular atrophy. In addition, they undergo, infectious disease screening prior to donation for HIV, hepatitis, gonorrhoea, syphilis, and chlamydia.

Can we use a known egg donor in Colombia?

Unfortunately no, as only anonymous donations are allowed in Colombia.

What testing is conducted on surrogate mothers?

Similar to egg donors, they undergo psychological screening, infectious disease screening, and an additional uterine cavity evaluation before embryo transfer.

How can we be sure that our surrogate in Colombia is taking proper care of herself and the baby?

Our local social workers frequently visit the surrogate’s homes as well as frequent medical visits and psychological check-ups throughout the whole process

Do we communicate with our surrogate throughout the process?

We can facilitate 3-way video conferences with a member of our team (this is done, as in most cases the surrogate mother will not speak English) so you can build a closer bond if required.

How many attempts will our surrogate mother agree to undertake?

Your surrogate mother will sign for up to 3 embryo transfers and in case they all fail then a new match will be undertaken until a successful result is achieved which is covered by our guarantee package.

I am an HIV+ male, is surrogacy possible?

Yes, we can perform sperm washing so that the use of the semen sample is possible. Additional costs will apply.

We are interested in twins. Can we implant 2 embryos?

Twins are by nature high-risk pregnancies, and the elevation of Bogota increases that risk. As a result, in the interest of the safety of surrogate mothers and babies, the medical team will only implant 1 donor-conceived embryo per attempt.

Is egg splitting with the implantation of a genetically related embryo from 2 different male partners possible?

No, it is not possible in Colombia. Two separate surrogate journeys must be undertaken which is shown in our double guarantee program.

What are the success rates?

Each case is different and unique, and only elective single embryo transfer will be conducted. In IVF, more than one transfer may be needed to achieve success, but this varies from case to case. Nevertheless, with superior medical practices, we have very high success rates.

What happens if we have a failed attempt?

If there are additional frozen embryos for transfer, a new transfer can often be conducted within 1 month. If there are no more embryos, an additional cycle will need to be conducted to produce more embryos, which is included in our guarantee program.

What prenatal monitoring is conducted during the pregnancy?

A beta HCG test is conducted approximately 2 weeks after embryo implantation. If the test is positive, a second test is conducted 48-72 hours later to track hormone levels. From there, a confirmatory ultrasound is conducted at approximately week 7 of gestation. The latest non-invasive prenatal testing (NIPT) is then conducted at week 10 to check for chromosomal issues with the fetus and can also tell the gender of your baby very early in the pregnancy. Ultrasounds will then be conducted monthly throughout the pregnancy.

Where will the birth take place in Colombia?

All births will take place in a private hospital unless a medical emergency necessitates otherwise. If this occurs a surrogate will be taken to the closest public hospital, but do not worry as Colombia due to recent medical reforms has a very good health care rating (20th in the world).

Do I need any specific vaccinations before attending the birth of my child?

In Colombia, intended parents must present proof of mandatory vaccine for DTP: Diphtheria, Tetanus, and Pertussis before the birth of their child.

Who will be represented on the birth certificate in Colombia?

Initially, the surrogate mother and the biological father will be on the birth certificate. Under Colombian law, the woman who gives birth to the baby is assumed to be the mother, but there is a court process to revise this. (Beforehand we recommend that you consult your local laws regarding the surrogacy and adoption laws in your country in order to avoid any further complications)

How long does it take to get the birth certificate in Colombia?

It can usually be acquired within 48-72 hours from birth.

Is the baby eligible for Colombian citizenship?

Due to Colombian law, the baby is eligible for a Colombian passport and citizenship. For many, this might have great value as it can be acquired quickly and possibly facilitate a quicker exit process. Many countries, including the European Union, do not require a visa (please check with your coordinator) for a Colombian citizen (your baby). This process may be much quicker than applying to your own embassy in Bogotá for citizenship and a home passport, but this will vary between countries.

Can the birth certificate be revised to remove the surrogate mother according to Colombian law?

Yes, under the Colombian Civil Code, there is a method to remove the surrogates name from the birth certificate. This is accomplished through a DNA test after birth to show no genetic relationship with the surrogate mother and one with the intended parent(s). A surrogate mother will also sign an affidavit giving full custody to the genetic father. Your legal team will process this as part of our guarantee program and can accomplish this even after you have returned home. This will leave the biological father alone on the birth certificate.

What is the detailed post-birth process in Colombia?

1. baby is born;
2. baby is released from hospital to intended parent(s) with a copy of the certificate of live birth;
3. the birth certificate is processed at a local notary which will represent the surrogate mother and the genetic father;
4. the surrogate will simultaneously sign, notarize, and apostille documents showing relinquishment of rights, consent for the intended parent(s) to travel, and consents for any adoption process in the home country that may be necessary (for example, in the case of same-sex couples where the partner wants parental rights);
5. if desired, you may apply for a Colombian passport if it aids your exit; process;
6. you may also simultaneously apply to your embassy for home citizenship and a home passport. We will assist with providing birth certificate and any translations that may be necessary, but only you can apply to your embassy and undertake their process; each country has a different process;
7. a DNA test through a local accredited lab is undertaken to show no genetic relationship with the surrogate mother and a genetic relationship to the intended parent(s);
8. you will provide a notarized power of attorney to your legal team who will file a disputation of maternity under Civil Code regulations; you may return home during the process and the law firm will process everything on your behalf;
9. When the case is processed and the sentence is given, your legal team will provide it to the notary to undertake a revision of the birth certificate; they will then send you the new document by courier to your home country.

What is the average time for the exit process after birth in Colombia?

Intended parents should always allow for flexibility at birth as each process is unique. The average time in Colombia is usually between 3 – 6 weeks and will completely depend on your country of citizenship and how fast the embassies can process your request.
